After Xiaomi it's OnePlus' turn in India to face the banhammer. The Delhi High Court has banned the Chinese company from importing and selling OnePlus One in India

Although the ban comes shortly after the Xiaomi case (which has been temporarily resolved), the two are for very different reasons. While Xiaomi was found infringing upon Ericsson's patents, OnePlus has been banned for shipping devices with CyanogenMod on them despite Micromax having an exclusivity deal with Cyanogen. The complaint was naturally made by Micromax, following which OnePlus has been temporarily banned from selling and importing devices with CyanogenMod in India, although the company can sell its existing stock.

We have heard before from OnePlus that the company is working on its own Android ROM, which was expected to be made available later this month. Following this ban, the company will have to expedite its work on the ROM if it intends to continue selling phones in India.

It's a temporary ban. One Plus would tie up with another dev and release new software.

Or may be cyanogenmod would scrap deal with Micromax if they behaved so rigid. Nothing to worry.

Ban on Xaiomi has already been lifted as they got stay order.

It seems these chinese companies are doing theese illegal things deliberately so that they can make some money before getting banned.........:laugh:

yes ...Xiaomi India ban partially lifted by Delhi HC after court decided that its Qualcomm-powered devices should not be affected by the ban.

But it seems Cyanogen terminated agreement with OnePlus & clarified that its agreement with Micromax supersedes all prior agreements. So OnePlus will have to come up with its own Android ROM atleast in India.
Cyanogenmod mod did nothing. They made agreement with Micromax for exclusive right of their OS but before that they have tied up with One Plus.

Now Micromax is creating the issue as per T&C of deal and sought ban on One Plus in India. So, either Micromax and cyanogenmod will settle it mutually.

Otherwise One Plus will demand compensation from cyanogenmod and later on replace their OS on all their handsets

The report atates.....

"OnePlus claimed it had entered a collaboration agreement and trademark licence agreement with Cyanogen in February to use its trademark and software in the entire world except mainland China. It also told the court that Cyanogen only informed it about the termination of their agreement a fortnight before its launch in India.

As a result, while Micromax has an exclusive licence for South Asia, OnePlus has a non-exclusive licence for the entire world except China. Cyanogen has clarified that its agreement with Micromax supersedes all prior agreements."

So it seems Cyanogen abruptly terminated the agreement with OnePlus.

Also court oberved that......

"The court also noted that while OnePlus may sue Cyanogen for breach of contract, the same will be governed by the laws of the state of California as per the agreement between them, and OnePlus will not have a remedy in India."

Its natural for Micromax to sue OnePlus in India to protect its interests.......So here OnePlus cann't do anything in India except to launch handsets with different ROM.
