The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has disposed of Star India’s miscellaneous applications in its dispute with multi-system operators (MSOs) IndusInd Media & Communications Ltd. (IMCL) and Goldstar Noida Network. Star India had filed these applications stating that while executing the interconnect agreement in pursuance of the order passed by the tribunal, the petitioners made the endorsement that the execution on its behalf was ‘without prejudice’. Star’s counsel Salman Khurshid stated that put at the bottom of the agreement, the endorsement leaves the door open for the MSOs to walk out of any of the clauses in the agreement, and the whole agreement was thus put in a state of uncertainty.
