I guess you need to be with the current operator for 3 months. It does not matter whether you are a new customer or a ported in customer.
NinadG Bro, the SMS you mentioned will in any case give you the port code - whether or not you are eligible.

1. 943XXX9494 - I want this no. to be bsnl

2. 82800XXX00 - this one is the one that I want to port
