Where is the law which states first SD channel would be added then the HD feed?

Both the feeds can me added at the same point.

I mean to say though they had named it DSport HD it very much looked like upscaled to HD.

This is what Dsport has said about addition on videocon. But the reason seems not right as what I understand is that there is no capacity constraints as of now.
