OFFER
“Tata Sky Diwali Offer (“ Offer ”) is a promotional
Scheme being offered by Tata Sky Limited (“ Tata
Sky”), applicable to Tata Sky Subscribers (“ You” /
“ Your” ), having a Tata Sky Standard Definition
connection. With this Offer, all Tata Sky subscribers
having subscribed to Standard Definition
connection will be able to upgrade to a High
definition set top box (having High Definition
connection) which would be provided on
entrustment basis, without payment of up-
gradation charges. However, payment of one-time
fee of Rs. 1500/- is mandatory, to view HD
channels for a period of 1 year.
The Offer is, in addition, to the existing promotional
scheme (if any) available from Tata Sky and this
Offer can be availed only from 20th October, 2014
to 26th October, 2014. After the completion of the
Offer Period, if You wish to upgrade your Standard
Definition connection to High definition set top box
connection then You will be charged the applicable
up-gradation fee in addition to the HD Access Fee.
In the event of You availing this Offer, in addition to
the terms and conditions stipulated in Specific
Terms and Conditions of Tata Sky Subscription
Contract and / or Specific Terms and Conditions of
Tata Sky Subscription Contract for Tata Sky
Hardware provided on Entrustment basis
(hereinafter, collectively referred to as the
‘ Subscription Contract’ ) and / or Everywhere TV
Terms and Conditions (‘EWTVT&C’ ), if applicable,
You shall be bound by the Terms and Conditions
contained herein this ‘ Offer Document’ .
For the sake of brevity, the Subscription Contract
and / or EWTV T&C, if applicable shall together be
referred to as the ‘ Agreement’
ELIGIBILITY
The Offer is open ONLY to Tata Sky Subscribers
who have subscribed to Standard Definition
connection.
This Offer is applicable against handover of Your
existing Tata Sky Standard Definition Box, to
Tata Sky.
This Offer cannot be availed by:
Tata Sky Subscribers who have already
subscribed to High Definition connection.
However, Multi TV subscribers with one
High Definition connection, and one or more
Standard Definition connection can avail this
Offer to upgrade a to High Definition
connection
Existing Subscribers of High Definition
Annual Access Fee.
Subscribers of Mega High Definition & Mega
South High Definition Packs
The following persons shall not be entitled to
avail this promotional scheme:
Employees and relatives of Tata Sky;
Tata Sky business associates including the
dealers and advertising agencies;
Anyone who may be involved with the
promotion such as Content Partners,
Vendors, Agencies etc.; and
Tata Sky reserves the right, at any time, to verify
eligibility requirements, in any manner deemed
appropriate.

GENERAL
Tata Sky reserves the right at any time, without
prior notice, to add or vary all or any of these
Terms and Conditions or to replace, wholly or in
part this promotional scheme or to withdraw it
completely.
Tata Sky will not be liable for any loss, damage
or cancellation of this promotional scheme
caused by Force Majeure Events which are
beyond its reasonable control including war,
natural calamities, floods, failure of
telecommunication network etc.
You consent to comply with these Terms and
Conditions and waive any right to claim
ambiguity in these terms and conditions and
release, indemnify and hold harmless Tata Sky
and its respective affiliates, advertising and
promotion agencies, and its respective agents,
partners, representatives, officers, directors,
shareholders and employees from and against
any injuries, losses, damages, claims, actions,
or any liability of any kind resulting from or
arising from You opting for this Offer
You acknowledge and agree that all disputes
pertaining to this Offer shall be subject to sole
and exclusive jurisdiction of the Courts located
in Delhi, India.
Tata Sky shall not be responsible for printing or
typographical errors in any promotional
materials; or for transactions that are lost,
misdirected, fail to enter into the processing
system, or are processed, reported, or
transmitted late or incorrectly or are lost for any
reason including computer, telephone, paper
transfer, mail system, human or other error; or
for electronic, computer, or telephonic
malfunction or error, including inability to
access the Tata Sky website or process any
transaction thereon.
All capitalized terms used herein shall have the
same meaning as ascribed to them in the
Subscription Contract.
In the event of any inconsistency between the
Subscription Contract and these Terms and
Conditions, in so far as this Offer Document is
concerned, the later shall prevail.
Headings used herein are for convenience only
and do not affect the interpretation of this Offer
Document.​
