On behalf of Star, it is contended that since Hathway had agreed to take its sports channels on RIO terms, it must also take its general entertainment channels on the rate and terms as fixed under its RIO.
It may be noted here that in April 2014, Star has issued a consolidated RIO covering both sports and general entertainment channels. It is its stand, therefore, that like the sports channels, Hathway must also take its general entertainment channels on RIO terms in all the regions where Hathway is operating. Mrs. Pratibha M. Singh, senior advocate appearing for Star forcefully argued that Hathway cannot be permitted to indulge in duality and take some of Star’s channels on RIO terms and some other channels on negotiated terms; again Hathway cannot take the same channels in different parts of the country on different terms. It must take all the channels of Star, both sports and of general entertainment, in all parts of the country, on the same terms and since it had earlier expressed the inclination to take the sports channels on RIO terms, it should also be made to take the general entertainment channels on the same terms.
