A fake JBL wireless speaker sold on Flipkart could turn into a legal wrangle. While counterfeit products being sold online are not new and all major e-commerce players including, Flipkart, Snapdeal and Amazon have been through it, the consumer in this case, Jay Samal, is planning to lodge a first information report (FIR) against the Bengaluru-based company for the hassle.

Flipkart, in its response to the consumer has described the event as 'rare' and 'isolated', adding it is investigating the matter internally. Samal has been re -funded the money he had paid for the speaker.

At least the customer came to know that the product is fake. Otherwise no one knows how many such 'rare' and 'isolated' incidents would have taken place.
Flipkart should run background checks on sellers in order to avoid these things which affect brand & image of Flipkart.

Many would be enjoying fake products happily thinking of grabbing a smart deals. Rarely someone like this man could differentiate between original and fake.

I don't think by filing an FIR will do any harm to flipkart legally if the product is not sold by ws.retail or as flipkart advantage.
The FIR has to be registered in the name of seller as per the TOS. flipkart will come clean on it. You should just have a look at their agreement with seller once.

As i have mentioned if you buy from ws.retail or flipkart advantage product then you may hold them responsible. Otherwise its a marketplace. Seller is held responsible.
